These Terms & Conditions (“Terms”) govern your access to and use of the websites operated by Wedland Group LLC (“Wedland,” “we,” “us,” or “our”), including Hoby.com and any related Shopify storefronts (collectively, the “Sites”), as well as your purchase and use of our products and services (together, the “Services”). By accessing or using the Sites or Services, you agree to be bound by these Terms.
1. Eligibility & Acceptance
- You must be at least the age of majority in your jurisdiction to place orders or use the Services.
- By using the Sites or Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
- If you do not agree to these Terms, you may not use the Sites or Services.
2. Our Role & Products
We curate and sell a variety of consumer products and services, which may include:
- Shelf-stable packaged food products (such as honey, dried mushrooms, maple syrup, and seasonings);
- Non-food physical goods (such as kitchen tools, home goods, accessories, and related items);
- Digital products, online content, and downloads;
- Tickets, reservations, or access to events, tastings, and experiences.
We generally act as a retailer and curator. Many products are manufactured and packaged by third-party producers. Product composition, ingredient lists, allergen declarations, safety warnings, and usage instructions are provided by the manufacturers and appear on the product packaging or labeling. We do not independently test every product batch and cannot guarantee that manufacturer-provided information is error-free.
3. Product Information
- We make reasonable efforts to display current and accurate product information, including descriptions, pricing, and availability.
- We do not warrant that product information, specifications, or packaging shown on the Sites are error-free, complete, or current.
- Actual packaging, materials, and colors may differ from what is shown online. You should always read labels, warnings, and instructions before using or consuming any product.
4. Orders, Pricing & Payment
- By placing an order, you offer to purchase products subject to these Terms.
- We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or product unavailability.
- Prices are displayed in the currency indicated on the Sites and are subject to change without notice.
- Taxes, shipping fees, and any applicable duties may be added at checkout where required.
- Payment must be made using the accepted payment methods at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method.
5. Shipping, Delivery & Risk of Loss
- Orders are fulfilled through third-party logistics partners and shipped via carriers such as USPS, UPS, DHL, FedEx, or similar providers.
- Processing times are typically stated on the Sites but are estimates only and not guarantees.
- Risk of loss and title for products pass to you when the carrier accepts and scans the package. Once the order is in the carrier’s possession, we are not responsible for delays, loss, or damage occurring in transit, except as required by law.
- You are responsible for providing a complete and accurate shipping address. We are not responsible for non-delivery or misdelivery due to incorrect or incomplete addresses.
6. International Orders
- We may offer shipping to destinations outside the United States. Availability and rates vary by location.
- International shipments may be subject to import duties, taxes, customs fees, and local regulations. These charges are the responsibility of the recipient and are not included in our product prices or shipping fees unless explicitly stated.
- We are not responsible for orders delayed, refused, held, or returned by customs or local authorities. In such cases, refunds may not be available, except as required by law.
7. Returns, Refunds & Replacements
Our goal is to stand behind the quality of our products while maintaining safety, fairness, and operational clarity. Because we sell different types of products, our return, refund, and replacement options vary by category, as outlined below and subject to applicable law.
7.1 Food & Perishable Products
Due to safety and quality-control requirements, we generally cannot accept returns of food or other perishable products once they leave our fulfillment center, except where required by law.
We may, at our discretion and subject to applicable law, provide a refund, credit, or replacement for food or perishable items if:
- Products arrive damaged, spoiled, or otherwise compromised at the time of delivery;
- You receive the wrong item; or
- Items are missing from your order.
If you experience an issue with a food or perishable item, you must contact us at [email protected] within 7 days of the documented delivery date and include your order number, a description of the issue, and photos if possible.
7.2 General Merchandise & Hard Goods (Non-Food)
For eligible non-food, non-perishable physical goods (for example, home, kitchen, or lifestyle items), we may accept returns within 30 days of the delivery date, provided that all of the following conditions are met:
- The item is unused and in like-new condition;
- The item is returned in its original packaging, including any accessories, manuals, and tags;
- You can provide proof of purchase (such as an order confirmation or receipt);
- The item is not identified as “final sale,” “non-returnable,” or subject to a different return window at the time of purchase.
We reserve the right to inspect returned merchandise and to reject returns or apply partial refunds if items are not in acceptable condition or if components are missing.
7.3 Electronics & Specialty Devices (If Offered)
If we offer electronics, appliances, or other specialty devices in the future, they may be subject to a shorter return window due to their nature (for example, 14 days from the delivery date) and may require that:
- The item be in like-new condition with all original packaging and accessories; and
- Any product-specific return instructions or requirements displayed at checkout be followed.
Any such category-specific rules will be posted on the product page or at checkout and will govern those items in addition to this Section 7.
7.4 Final Sale, Hygiene-Sensitive & Limited-Return Items
Certain items may be designated as final sale, non-returnable, or subject to limited return options. These may include, for example:
- Food and other perishable products;
- Digital products and downloadable content;
- Event tickets, experiences, and reservations, once confirmed;
- Personal care, hygiene-sensitive, or intimate items that cannot be resold for health or safety reasons once opened;
- Items marked “final sale” or otherwise non-returnable at the time of purchase.
Where products are identified as final sale, non-returnable, or subject to a different return window at the time of purchase, those terms will control.
7.5 Process for Returns, Refunds & Issues
If you experience an issue with your order or wish to inquire about a return, you must contact us at [email protected] within the applicable timeframe (for example, 7 days for damaged food items, 30 days for eligible general merchandise), and include:
- Your order number;
- A description of the issue or reason for the return; and
- Photos of the product and packaging, if appropriate.
We will review your request and, where appropriate, provide instructions for return shipping or offer a refund, credit, or replacement in accordance with these Terms and applicable law.
Unless otherwise stated or required by law, you are responsible for return shipping costs for change-of-mind returns on general merchandise. We are not responsible for items lost or damaged in transit during return shipment.
8. Digital Products, Events & Experiences
- We may offer digital products, online content, courses, tastings, events, or other experiences.
- Unless otherwise stated at the time of purchase, all sales of digital products and event tickets are final and non-refundable once delivered or confirmed.
- Event-specific terms, including cancellation and refund rules, will be presented at checkout and will govern those experiences in the event of any conflict with these Terms.
9. User Accounts
- Some features may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You agree to notify us promptly of any unauthorized use of your account or credentials.
10. Acceptable Use
You agree not to:
- Use the Sites or Services for any unlawful purpose;
- Interfere with or disrupt the operation of the Sites or the servers or networks used to make the Sites available;
- Attempt to gain unauthorized access to any portion of the Sites, accounts, or systems;
- Use bots, scrapers, or other automated tools to access the Sites except as allowed by applicable law and our explicit permission;
- Engage in any activity that could damage, disable, overburden, or impair the Sites or Services.
11. Intellectual Property
All content on the Sites, including text, images, logos, branding, graphics, video, and other materials, is owned by Wedland Group LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, display, or create derivative works based on any content without our prior written consent, except as expressly allowed by law.
12. Disclaimers
The Sites and Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Sites will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee the accuracy or completeness of any product information, manufacturer labeling, or third-party content.
13. Limitation of Liability
To the fullest extent permitted by law, Wedland Group LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of the Sites or Services, even if advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the Sites, Services, or products you purchase is limited to the amount you actually paid for the product or service at issue.
14. Indemnification
You agree to indemnify, defend, and hold harmless Wedland Group LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Sites or Services, your violation of these Terms, or your violation of any rights of another.
15. Governing Law & Dispute Resolution
These Terms and any disputes arising out of or related to them will be governed by the laws of the State of California, USA, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction and venue of such courts.
16. Changes to These Terms
We may update or modify these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Sites or Services after any changes become effective constitutes your acceptance of the revised Terms.
